These Terms explain how the Shifting Lives website may be used and clarify the limits of the information it provides.

They apply to your use of shiftinglives.au. Separate arrangements may apply if you book counselling or another paid service with Shifting Lives.

No counselling relationship from website use

Reading the website, watching a video or sending a general enquiry does not by itself create a counsellor-client relationship.

Not a crisis service

Shifting Lives is not an emergency or crisis-response service. If you need urgent help, use the Urgent Support page rather than waiting for a response from Shifting Lives.

Your legal rights remain

Nothing in these Terms excludes any consumer guarantee, right or remedy that cannot lawfully be excluded.

1. About These Terms

This website is operated by Shifting Lives Pty Ltd, ABN 33 634 472 941.

By accessing or using this website, you agree to these Website Terms of Use & Disclaimer.

If you do not agree with these Terms, you should stop using the website.

These Terms apply to the public Shifting Lives website, including its pages, articles, videos, transcripts, case studies, forms and downloadable resources.

They do not replace any separate agreement, informed-consent process, booking arrangement or privacy notice that may apply if you receive counselling or another service from Shifting Lives.

2. General Information Only

The information available through this website is provided for general educational and informational purposes.

Website content may discuss counselling, relationships, communication, behaviour, patterns, mindfulness, Evolutionary Therapy, personal development, distress and other wellbeing-related subjects.

This public material is not tailored to your individual circumstances and should not be treated as:

  • medical advice;

  • psychiatric or psychological advice;

  • a diagnosis;

  • a personalised treatment plan;

  • legal advice;

  • emergency or crisis guidance; or

  • a substitute for advice from an appropriately qualified professional who understands your circumstances.

Do not delay seeking appropriate professional, medical or emergency support because of something you have read, watched or heard through this website.

You remain responsible for deciding whether general website information is relevant or appropriate for your circumstances.

3. No Professional Relationship Through Website Use

Using this website does not by itself create a counsellor-client, therapeutic, fiduciary or other professional relationship between you and:

  • David Chittenden;

  • Shifting Lives Pty Ltd; or

  • any future practitioner associated with Shifting Lives.

A professional counselling relationship is not created merely because you:

  • read an article;

  • watch a video;

  • read a transcript or case study;

  • subscribe to future educational content;

  • submit a general contact form;

  • send an email;

  • follow Shifting Lives on social media; or

  • view booking availability.

A counselling relationship begins only after Shifting Lives has agreed to provide the service and the applicable booking, intake, consent and service arrangements have been completed.

Submitting an enquiry does not guarantee that Shifting Lives will be able to accept you as a client.

4. Counselling Services and Separate Agreements

Counselling and other paid services may be subject to separate arrangements covering matters such as:

  • service suitability;

  • scope of practice;

  • session format and duration;

  • availability;

  • fees and payment;

  • cancellations and rescheduling;

  • confidentiality and its limits;

  • privacy and health-information handling;

  • informed consent;

  • record keeping;

  • telehealth arrangements; and

  • professional or jurisdictional requirements.

Those arrangements may be provided during booking, intake or before services begin.

If there is an inconsistency between these Website Terms and a service-specific agreement, the service-specific agreement will govern the professional service to the extent of the inconsistency.

These Website Terms will continue to govern use of the public website.

Shifting Lives may recommend another service or practitioner where a person’s needs appear to fall outside the services Shifting Lives can appropriately provide.

5. Evolutionary Therapy

“Evolutionary Therapy” is the name David Chittenden uses for his own integrative way of exploring patterns, behaviour, adaptation, experience and choice within counselling.

It is presented on this website as David’s framework or lens for working with people.

It is not represented as:

  • an accredited standalone therapy modality;

  • a standardised clinical protocol;

  • a universal explanation of human behaviour;

  • a diagnosis;

  • a guaranteed treatment;

  • a substitute for medical, psychological or psychiatric care; or

  • a framework that every counsellor or practitioner must use.

Public explanations of Evolutionary Therapy are intended to help visitors understand David’s perspective and working style.

They should not be interpreted as proof that one explanation applies to every person or every situation.

6. Outcomes and Individual Circumstances

Counselling experiences and outcomes vary.

Shifting Lives does not guarantee:

  • that counselling will produce a particular outcome;

  • that symptoms or distress will improve within a particular timeframe;

  • that a relationship will continue, reconcile or end;

  • that a particular pattern will change;

  • that insight will automatically produce behavioural change;

  • that one person’s experience can be reproduced for another person; or

  • that any service will be suitable for every person.

Any references to change, movement, progress, insight, recovery or improved circumstances should be understood in the context of individual experience.

The person receiving counselling retains responsibility for their choices and participation.

This does not limit any professional duty or legal obligation that applies to Shifting Lives.

7. Urgent and Crisis Support

Shifting Lives is not an emergency or crisis-response service.

Do not use:

  • the website contact form;

  • email;

  • social media;

  • voicemail;

  • a booking request; or

  • a future community or messaging feature

to seek immediate emergency assistance.

If you or someone else is in immediate danger, call Triple Zero (000) or go to the nearest emergency department.

Do not wait for a response from Shifting Lives if immediate support is required.

8. Resources, Videos and Case Studies

The Shifting Lives Resource Centre contains educational material including:

  • videos;

  • articles;

  • transcripts;

  • reflections;

  • case studies; and

  • explanations of counselling-related ideas.

These resources are intended to encourage learning and reflection.

They should not be used to self-diagnose or to determine a course of medical, psychological, legal or emergency action.

Case Studies

Case studies may be based on historical counselling accounts or individual experiences.

Names and identifying details may be removed, changed or generalised to protect privacy.

Case studies are provided for educational purposes.

They are not:

  • testimonials;

  • proof of clinical effectiveness;

  • promises of a similar outcome;

  • evidence that the same approach is suitable for another person; or

  • a substitute for professional assessment.

Transcripts

Shifting Lives aims to provide useful and accessible transcripts for important video resources.

Although reasonable care is taken, a transcript may contain minor transcription, punctuation or formatting errors.

Where a transcript differs materially from the spoken video, visitors are encouraged to contact Shifting Lives so the issue can be reviewed.

Sensitive Content

Some resources discuss suicide, self-harm, abuse, trauma, panic, relationship conflict or other potentially distressing subjects.

Content notes and urgent-support links may be provided where appropriate.

The presence of a content note does not replace individual judgement about whether the material is suitable to read or watch.

9. Accuracy and Website Availability

Shifting Lives aims to keep website information accurate, clear and reasonably current.

However:

  • information may change;

  • errors or omissions may occur;

  • older resources may reflect the context in which they were created;

  • external services may change their contact details or availability;

  • research, professional guidance and legal requirements may change over time; and

  • the website may occasionally be unavailable due to maintenance, technical issues or circumstances outside our control.

Shifting Lives may update, correct, remove or replace website content where appropriate.

No representation is made that the website will always be:

  • uninterrupted;

  • error free;

  • compatible with every device or browser;

  • free from every technical issue; or

  • suitable for every intended purpose.

Shifting Lives may restrict access or take appropriate action where website use appears unlawful, harmful or disruptive.

Unless otherwise stated, intellectual property in the Shifting Lives website and its original content is owned by or licensed to Shifting Lives Pty Ltd.

  • downloadable resources; and

  • the arrangement and presentation of website content.

You may view and use website content for personal, non-commercial purposes.

You must not reproduce, republish, sell, distribute, adapt or commercially exploit Shifting Lives content without prior written permission, except where permitted by law.

Nothing in these Terms prevents:

  • lawful fair dealing;

  • use of assistive technology;

  • accessibility-related transformation permitted by law; or

  • other uses that cannot lawfully be restricted.

Third-party content remains the property of its respective owner and may require separate permission.

13. Privacy and Sensitive Information

The handling of personal information is addressed separately in the Shifting Lives Privacy Policy.

Health and counselling-related information may be sensitive.

When using a general enquiry form, provide only the information reasonably necessary for Shifting Lives to understand and respond to your enquiry.

Do not submit extensive medical records, highly sensitive personal information or urgent safety information through a general website form unless Shifting Lives has specifically asked you to use an appropriate process.

Website contact forms are not emergency channels and should not be treated as secure clinical-record systems.

Third-party booking, video, payment or communication providers may also process information under their own privacy policies.

14. Accessibility

Shifting Lives aims to provide an accessible website and uses WCAG 2.2 Level AA as the working accessibility baseline.

Subject to those non-excludable rights, and to the maximum extent permitted by law, Shifting Lives is not responsible for indirect or consequential loss arising solely from:

  • reliance on general website information;

  • temporary website unavailability;

  • use of a third-party website or service;

  • third-party content;

  • failure to seek appropriate professional or emergency support; or

  • use of website content outside its intended informational purpose.

This limitation does not apply where liability cannot lawfully be excluded or limited.

Nothing on this page should be interpreted as removing any obligation to provide paid services with the level of care and skill required by applicable law.

Shifting Lives may update these Website Terms from time to time to reflect changes to:

  • available services;

  • technology;

  • third-party platforms;

  • legal or regulatory requirements; or

  • business operations.

The updated version will be published on this page with a revised “Last updated” date.

Changes apply from the date they are published unless otherwise stated.

An update to these Website Terms does not automatically alter a separate counselling or service agreement already entered into with a client.

17. Governing Law

These Website Terms are governed by the laws of Queensland, Australia.

Subject to any rights that cannot lawfully be excluded, disputes concerning these Website Terms are subject to the jurisdiction of the courts of Queensland and any courts entitled to hear appeals from them.

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to operate to the extent possible.
